The Fayetteville City Council on April 7 will get its first look at a proposed amendment to the sexually-oriented business ordinance, one that provides a range of updates and definitions to the ordinance first adopted in 1998.
Also noteworthy, and immediately following the meeting in the council chambers, Councilman Larry Dell will shed his increasingly long locks as part of a fund-raising effort for the Cancer Wellness Center at Piedmont Fayette Hospital.
The council will hold a public hearing and hear the first reading of a proposed amendment to the city’s sexually-oriented business ordinance.
Though originally adopted in 1998, the proposed amendment is being recommended to address several current issues pertaining to adult businesses.
Those include limiting sexually-oriented businesses to the light and heavy manufacturing districts, clarifying certain definitions in the ordinance and providing the findings of a number of studies associated with adverse secondary effects of sexually-oriented businesses in communities in the United States, senior planner Linwood Robinson said in an April 7 memo.
Included in the proposed amendment is the definition of the “substantial business purpose” of a sexually-oriented business and its “adult items” where one or more of certain criteria are met.
Those include at least 25 percent of the displayed merchandise, at least 25 percent of the wholesale value of displayed merchandise, at least 25 percent of the retail value, at least 25 percent of revenue from sale or rental or at least 25 percent of the floor space for sale, display or rental of adult items.
Also included in the criteria are businesses than maintain at least 500 square feet of floor space for adult items, those that regularly sell or rent at least 2,000 adult items, those that regularly sell and advertise adult items or those that maintain an adult arcade.
Also at the meeting, the council will hear the first reading of proposed amendment to the FY 2011 General Fund budget which calls for a $133,104 decrease to $9.579 million. Accounting for the decrease, Finance Director Lynn Robinson in a recent memo noted the decreases in property and business taxes, licenses and permits, fines and forfeitures and interest revenues.
And in what will likely be a one-of-a-kind display of support immediately following the meeting, Dell will have his ever-growing long locks sheared in support of the hospital’s wellness center and in honor of his sister who is undergoing cancer treatment.
The move by Dell is in conjunction with Leadership Fayette and the Fayette Chamber of Commerce cancer fund-raiser on April 9 for the Piedmont Fayette Hospital Wellness Center.
