The Fayette County Zoning Board of Appeals is a body comprised of five members who are appointed to three-year terms.
The purpose of the Zoning Board of Appeals is to hear and decide upon appeals where it is alleged there is error in any order, requirement, decision, or determination made by the zoning administrator in the enforcement of regulations. The Zoning Board of Appeals may, in conformity of the provisions of regulations, reverse or affirm the order, requirement, decision, or determination of the zoning administrator. The board may also direct the issuance of a permit.
The Zoning Board of Appeals may also authorize, upon appeal in specific cases, a variance from the terms of regulations as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of regulations will, in an individual case, result in practical difficulty or unnecessary hardship, so that the spirit of the regulations shall be observed, public safety and welfare secured, and substantial justice done.
Each member of the Fayette County Zoning Board of Appeals must be a resident of Fayette County. No member of the Zoning Board of Appeals may hold any other public office, except that one member may also be a member of the Planning Commission.
The Zoning Board of Appeals meets, as needed, on a monthly basis at 7 p.m. at the Fayette County Administrative Complex, 140 Stonewall Avenue West in Fayetteville. Board members are compensated $75 per meeting but no more than $150 per month.
The Fayette County Board of Commissioners would like to notify interested Fayette County citizens that three positions on the Zoning Board of Appeals are available for appointment with terms beginning January 1, 2017 and expiring December 31, 2019.
The Fayette County Board of Commissioners will be accepting applications with resumes for this position.
