Coweta County OKs variance for senior community

A planned senior community along Hollz Parkway off Ga. Highway 34 near Newnan approved in 2014 received permission on June 28 to amend one of the conditions dealing with the width of the roadway extension adjacent to the development.

JHP Family Investments representative and Atlanta attorney Doug Dillard presented the case to have the previous agreement to construct a four-lane divided road adjacent to the future development amended to require that the developer be responsible for constructing a two-lane divided roadway instead.

Dillard’s point was that the development, which is essentially the beginning of the extension of Hollz Parkway from where it currently ends a short distance from Hwy. 34, would not generate enough traffic to a level that would require four lanes.

County staff noted that sufficient right-of-way is currently in place to expand the roadway to four lanes at a future date. Hollz Parkway will eventually extend to Interstate 85 where a planned interchange will link it to the road network on the west side of the expressway, staff added.

Dillard in his comments cited various case law to make the case for the request. Commissioner Tim Lassetter in response said JHP has previously agreed to the four-lane condition.

Dillard answered, saying that the owner cannot waive his rights.

Commissioners after a brief discussion approved the request by unanimous vote.
